Intellectual Property Rights

The Information (including any information, data or other materials made available if you are accessing a Product), and all designs, text and graphics on the Site and the selection or arrangement thereof, along with all software and databases forming part of the Site and/or provided by PV Intelligence Limited (together, the “Materials”) are owned by and are confidential to PV Intelligence Limited or its licensors, and are protected by copyright, database rights and other intellectual property rights throughout the world.
All copyright, database rights and other intellectual property rights in the Materials are and shall remain vested in PV INTELLIGENCE LIMITED or its licensors, and except as expressly provided or granted to you or the Client by PV Intelligence Limited pursuant to a Subscription Agreement or otherwise, you or the Client will not acquire any right, title or interest in or to the Materials and no such rights are or shall be implied.
By accessing any Product, you thereby warrant and represent that you have taken all requisite actions and obtained all necessary third-party consents and licences to enable you to: (a) receive the benefit of the Products and (b) fulfil your obligations under the Research Agreement.
Where any of the Materials contain or have affixed to the trademarks, trade names, notices or other proprietary marks of PV Intelligence Limited or its licensors, you may not alter, obscure, remove, interfere with or add to any of the said trademarks, trade names, notices or proprietary markings.
If you are accessing a Product made available on the Site, you may use the Materials contained in the Product in accordance with the terms of the applicable Research Agreement. If you wish to use such Materials for other purposes, you may only do so if you have first obtained PV Intelligence Limited’s prior written consent (which PV Intelligence Limited may withhold in its absolute discretion). You may be held responsible for any infringement of PV Intelligence Limited’s intellectual property rights that arise out of or are connected with your granting any unauthorized user access to any Products made available on the Site.
For all other Materials made available on the Site, you may view, download and print such Materials for your own personal and private use provided that they are not altered or changed in any way and are not used, in whole or in part, in any other publication, in whatever medium. Otherwise, the Materials on the Site may not be stored, copied, reproduced, transmitted or otherwise made available on any network or in any other medium, in whole or in part, without the prior written consent of PV Intelligence Limited.
Where the Materials comprise any software, you may not decompile, disassemble or reverse engineer any object code of such software, save to the extent expressly permitted by Section 50B of the Copyright, Designs and Patents Act 1988.

Whilst PV Intelligence Limited believes such websites and resources may be of interest to you, PV Intelligence Limited does not endorse or accept any responsibility for the content or the use of such websites and resources. Use of these links is therefore made at your own risk and PV Intelligence Limited accepts no liability for any linked websites or resources. You must also take your own precautions to ensure what is selected is free from any viruses, worms, Trojan horses or other items of a destructive nature.
You may link to our home page, but only provided you comply with the following provisions. In linking to our home page, you must do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part when none exists. You must not establish a link from any website that is not owned by you. The Site must not be framed on any other website, nor may you modify the Site when linking to it. Subscriptions

Free Trial Terms:
Your subscription begins as soon as your initial payment is processed. Your trial starts immediately after sign-up. You will be granted a limited access to the platform and certain features will be deactivated until you choose to upgrade to a paid package.Your eligibility to use PVDATA’s free trial offer is determined solely by PV Intelligence Limited. Your access to any free trial offer is provided at PVDATA’s sole discretion. -
Subscription Terms:
Your subscription begins as soon as your initial payment is processed. Your subscription will automatically renew annually without notice until you cancel. You authorize us to store your payment method(s) and to automatically charge your payment method(s) every month until you cancel. We will automatically charge you the then-current rate for your plan, plus applicable taxes (such as VAT or GST if the rate does not include it), every month of your contract length until you cancel. The length of our subscription package is 3months from the moment your initial payment is processed, and your term will keep on rolling thereafter until you decide to cancel.We may change your plan’s rate and we will notify you of any rate change with the option to cancel. If the applicable VAT or GST rate (or other included tax or duty) changes during your term, we will accordingly adjust the tax-inclusive price for your plan on your next billing date. If your primary payment method fails, you authorize us to charge any other payment method in your account. If you have not provided us a backup payment method(s) and you fail to provide payment, or if all payment methods in your account fail, we may suspend your subscription. You can edit your payment information anytime on your PVDATA software. For European Economic Area customers, your bank may require you to authenticate your initial purchase using a password, a one-time code sent to your mobile number, or biometric recognition. When you authenticate, you also authorize us to charge your payment method for your additional purchases without providing us further payment information or other instructions (i.e., we will initiate future payments independently). Such additional purchases may occur when we automatically charge your payment method in connection with a recurring subscription or when you add or change licenses or products. -
Pay-As-you-go Terms:
This payment package does not come with a fixed term period. Users therefore subscribe to this package whereby payments will only be made each time the authorised user successfully runs a simulation on the PVDATA software and gains access to the provided data/reports. You authorize us to store your payment method(s) and to automatically charge your payment method(s) every time a successful simulation is made.We may change your plan’s rate and we will notify you of any rate change with the option to cancel. If the applicable VAT or GST rate (or other included tax or duty) changes during your term, we will accordingly adjust the tax-inclusive price for your plan on your next billing date. If your primary payment method fails, you authorize us to charge any other payment method in your account. If you have not provided us a backup payment method(s) and you fail to provide payment, or if all payment methods in your account fail, we may suspend your subscription. You can edit your payment information anytime on your PVDATA software. -
Cancellation Terms:
Under the Subscription package, you may cancel your plan at anytime after 3months without a cancellation charge. Cancellation charges may vary in cost, however, will not exceed the total value equivalent to a 3-months subscription cost. For more information, contact us.Under the Pay-as-you-go package, you may cancel your plan at anytime for free, without any cancellation charge.

Limitation of Liability

Nothing in these Conditions of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied.
Subject to the provisions above, PV Intelligence Limited will not be liable for the following types of loss or damage from claims arising out of or relating to these Conditions of use, howsoever caused and whether such claims are based on negligence, breach of contract, strict liability, breach of statutory duty or otherwise:
(a) loss of profits, business, contracts, revenue, goodwill or anticipated savings (whether such loss is direct or indirect, foreseeable or otherwise); or
(b) indirect or consequential loss.
Different limitations and exclusions of liability apply to the accessing of Products on the Site, which are set out in the relevant Research Agreements granting the right to access those Products.

Security and Right of Access to the Products

Where you have been provided with a login details in order to access and use a Product, you are solely responsible for all use of the said login details and must ensure they are kept confidential at all times and access to your account by any other party other than the authorised user is prohibited. Thus, you may not share or transfer the login details or access to PVDATA’s technology to any third party, including any other employees of the Client. You must notify PV Intelligence Limited immediately if you become aware of any unauthorized use of your login details or any other breach of security regarding access and use of the Products that becomes known to you.
Access and use of each Product from the Site is limited to the authorized users and locations as specified in the relevant Subscription Agreements. If your entitlement to access and use a Product is the result of the Client entering into a Subscription Agreement with PV Intelligence Limited, you have no independent right to access and use the Products, and your right to access and use the Products will cease when your employment with the Client terminates, or when the Client terminates its Subscription Agreements with PV Intelligence Limited. You and the Client shall be responsible for notifying PV Intelligence Limited of the termination of your employment, and for any unauthorized use of the Products by you after your employment with the Client ceases.

Privacy and Cookies

PV Intelligence Limited’s policy on data protection, privacy and cookies is set out in its privacy policy, which is incorporated by reference into these Conditions of use and which you should also read.

PV Intelligence Limited’s Rights
- We reserve the right to refuse, suspend or cancel the registration or use of any User for any reason without notice, including if a User has breached these Terms of Service.
- We also reserve the right to remove, block or prevent from being visible any of your Posted Content, at any time and without compensation.
- We reserve the right to upload user’s company logo on our website without giving notice.

Governing Law and Jurisdiction

These Conditions of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. Both parties agree to the exclusive jurisdiction of the English courts, except that PV Intelligence Limited may pursue injunctive relief or similar to enforce the provisions of these Conditions of use in any appropriate forum.

To the extent that you access and use any Products made available on the Site, you acknowledge that you are bound by the terms of the Subscription Agreement(s) which have been entered into by yourself or the Client.
These Conditions of use, together with the Subscription Agreements (where you are accessing and using a Product) and privacy notice and cookie policy, constitute the entire agreement between you and PV Intelligence Limited relating to your use of the Site, and supersede all other or previous agreements and understandings between you and PV Intelligence Limited.
PV Intelligence Limited may amend these Conditions of use at any time by posting such changes on this page of the Site.
Welcome to PVDATA. This website pvdata.io and associated technology (Technology) is owned and operated by PV Intelligence Limited. Should you continue to use the Technology, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Privacy Policy govern PV Intelligence Limited’s relationship with you in connection with the Technology. Should you not agree with any of the terms and conditions in this Agreement, please do not use the Technology.
